Texas Man Gets Life Sentence for Ninth DWI
The ninth conviction was the breaking point for one Texas judge who earlier this week sentenced a habitual drunken driver to life in prison.
Bobby Stovall, 54, was driving his truck in Round Rock, Texas, in early July when he weaved through several lanes of traffic and hit another vehicle, injuring the driver. It was later determined that Stovall had a blood alcohol concentration of .32, four times the legal limit in Texas.

And while that DWI was certainly enough to get Stovall in trouble with the law, when the judge found out the defendant had eight prior DWI convictions across several different counties in Texas, he ordered up a life sentence for Stovall.
"This is someone who very deliberately has refused to make changes and continued to get drunk and get in a car and before he kills someone we decided to put him away," said Williamson County District Attorney John Bradley.
Bradley said that in addition to the multiple DWI convictions , Stovall also had a extensive rap sheet for other crimes, including burglary, credit card abuse and supplying alcohol to a minor.

"He basically walked through the penal code for the past twenty years without any regard for safety or society," said Bradley. "In every single one of his cases he had an opportunity to change."
But some argue that Stovall's sentence was too harsh and that the court should have considered his struggle with alcoholism.
"This guy has a disease, he is an alcoholic and this isn't the kind of situation where he's acting with malice to hurt people," said Lawrence Taylor, a DUI lawyer and author of "Drunk Driving Defense."
"He has a serious problem and I hope the days are past where we think alcoholism is something you choose," said Taylor.
Taylor said that he does not agree with the judge's sentencing of Stovall and would have preferred more "rehabilitation" than "ending his life."
"You're essentially doing just that, ending this man's life, at the expense of taxpayers," he said.
But Bradley says that it's better to lock up a man like Stovall -- and prevent him from hurting someone in the future -- than give him yet another chance.
"I think that the ninth time you get caught and punished for [drunken driving] you would have found some way of not getting in that car," said Bradley.
"It's a big dodge to focus on the disease and not the crime," said Bradley. "It's a huge social excuse for dangerous conduct."
Williamson County, Bradley said, has long had a reputation for handing down harsh sentences to those who commit violent felonies or who are repeat offenders.
About two people per year receive sentences for repeat drunk driving convictions, said Bradley.
"The point is to prevent crimes," said Bradley, who added that the county boasts one of the dui consequences lowest crime rates compared to other Texas counties of similar size.
"If this guy was using a shotgun to shoot lights randomly around his neighborhood I doubt we'd be [getting criticized] for the sentencing," he said. "In this case he's simply using his truck as his weapon."
Stovall would be eligible for parole in five years, but depending on his conduct in prison and other factors, that could be as long as 10 driving under influence to 15 years.

Golf Is Both Banned and Booming in China
In this day and age, we've come to expect to see images of U.S. presidents gracing gossip websites and the covers of tabloid newspapers. But rarely, as it was recently, is golf at the heart of the discussion.
After breaking briefly from a two-week vacation on Martha's Vineyard to publicly address the savage beheading of American journalist James Foley at the hands of Islamic State militants, Barack Obama headed straightaway to Vineyard Golf Club for a round of golf. Photos showed him on the course, grinning and fist-bumping with the likes of former NBA star Alonzo Mourning and millionaire investor Glenn Hutchins.
Critics from both sides of the political spectrum said the president's actions were "tone deaf" and in "bad taste." Deputy White House Press Secretary Eric Schultz had to come to his boss's defense, saying "sports and leisure activities are a good way for release and clearing of the mind."
No matter where your opinion falls on this particular controversy, one thing is clear: Something like this would never happen in China. Because high-ranking Chinese officials know if they get caught on the links, it would be political suicide.
China has always had a complicated relationship with golf. Mao banned the game in 1949 when the Communists took power, denouncing it as the "sport for millionaires." Even today, those Chinese who have heard of golf likely know it as the "rich man's game," and in China that's precisely what it is. It's a prohibitively expensive pastime (an average round will cost you more than $150) in a country where nearly a billion people live on less than $5 a day. In fact, so ingrained is golf's image as an elitist pursuit, the Chinese Communist Party has been known to send notices to cadres warning them not to play, lest they be labeled corrupt. Some Western journalists even branded golf "green opium," a dangerous import that Chinese leaders believed to be a gateway to further decadence.
Perhaps now more than ever, thanks to President Xi Jinping's ongoing crackdown on government corruption, golf remains a taboo topic for China's political elite. Put simply, there's no way Chinese officials should be able to afford to play golf in China. Their salaries are modest (last year, it was reported that the annual salary for Xi himself was just $19,000) and, while most Chinese assume that all government officials have other sources of income, regularly playing golf game golf online would be a rather conspicuous admission of impropriety.

Now, we all know many Chinese officials are indeed filthy rich, and, yes, it's likely some do play golf -- but they know enough to do so in secret.
It's been more than a quarter century since a photo of a member of China's ruling class holding a golf club went public. Zhao Ziyang - the country's premier from 1980 to 1987 and general secretary, the Communist Party's highest-ranking official, from 1987 to 1989 - was the only top-level Party official to be relatively open about his golf habit. Zhao could regularly be found teeing it up at Beijing International Golf Club, near the famous Ming Tombs, where thirteen Chinese emperors were buried.
Zhao was not your typical Chinese leader, and perhaps that's why he was ousted and sentenced to house arrest not long after taking a sympathetic stance toward the Tiananmen Square student protesters in 1989. Zhao eschewed traditional Mao suits in favor of Western-style jackets and ties. He agreed to appear on the American television news show Meet the Press - downing two beers while on camera during his interview with Tom Brokaw.
Zhao's detractors branded these as examples of the "bourgeois liberalizations" he was allowing to pass through China's once airtight seal. Back in 1987, The New York Times had called Zhao the "dapper heir" to reform-minded Deng Xiaoping. In its article, it even noted a photo distributed by the Xinhua News Agency, China's official government media mouthpiece, that "shows [Zhao] on the golf course wearing a white baseball cap and clutching what knowledgeable observers believe is a three-iron."
When asked what would happen if newspapers were to somehow publish photos of China's current president enjoying a round of golf, one course manager predicted there would be one million new golfers in China the following day. "I think the possibility of that ever happening is zero," Song Liangliang, a spokesman for the China Golf Association, told me. "Photos of Zhao Ziyang caused such public turmoil back then."
And yet China is considered the savior to a global golf industry that's in serious trouble. Just last year in the United States alone, the number of golf free online games active golfers shrank by 400,000 and 160 courses shut down. This has been the trend for the better part of the past decade.
Meanwhile, in China, the numbers have been trending upward since the country's first modern-day golf course opened 30 years ago -- golf has grown in lockstep with the booming Chinese economy, especially in recent years. In China, there are few things more aspirational than golf, and the luxurious lifestyle believed to surround it. It's a status symbol, a sign that you've "made it," like an Audi A6 or a Louis Vuitton handbag. Indeed, many of the new golf courses in China were built more as a way to help sell the mansions that line the fairways than to attract golfers to play on them.
It's difficult to pin down just how many actual golfers there are in China. Estimates range from several hundred thousand to several million, with the true figure likely lying somewhere in the middle. One thing everyone agrees on, however: The number is increasing, which is more than most other places in the world can say.
But it would be wrong to say golf fever is sweeping the country. China is a nation of peasant farmers, some 700 million of them. Truth is, most Chinese probably have no idea what golf is. They can't afford to. Golf will likely always be a niche sport in China, but with a population of 1.4 billion, a niche there can still mean millions of people.
That the global golf industry has its hopes pinned so tightly to China shows just how uncertain the market truly is. Statistically, zero percent of the country's population plays golf. Oh, and it's supposedly illegal to build golf courses there, as well.
China's latest ban on golf development came in 2004, when the government, citing the "blind construction" of courses, issued a moratorium intended to protect "the collective land of the peasants" and curb an out-of-control real estate market. With more than a billion mouths to feed and limited water and arable land, the concerns were obviously valid. But after the ban, the government in effect turned its back and let things grow even more out of control. Over the past decade, no country has built more golf courses than China - not even close.
Ten years ago, when the moratorium went into place, state media reported that China was home to 176 golf courses, and only 10 of them had received proper approvals from the government. Today, proper approvals don't even exist, and yet some estimate that the number of courses in China has eclipsed 1,000, although there's no way to know how many there really are. (In 2009, the Ministry of Land and Resources admitted they were using satellite imagery to try to get a handle on the number.)
Every foreign business knows that when they enter the Chinese market, they are going to have to play by China's rules, but when it comes to golf, no one knows what the rules actually are. Truth is, no golf course in China gets built without heavy government involvement, but it's always at the local level. Local officials in China often welcome and encourage golf development because they profit mightily from it. Thus, they are willing to gloss over the rules a bit. Rule No. 1 when planning a golf course in China: Don't call it a golf course.
Those in golf course design and construction have to play along and weather the occasional crackdown, because these days if they aren't working in China, they probably aren't working much at all.

But beyond being a standout furniture piece, the dining table needs to be sturdy as a rock, comfortably accommodating and, in some instances, even flexible in shape and size.
That said, here are the essentials you need to know when shopping for a new dining table.
Consider the material. If you're going for a wood used chairs dining table, always opt for hardwood such as mahogany, walnut, maple, oak, or teak instead small home office desks of composite wood, which include plywood, hardwood solids and MDF (Medium Density Fiberboard). And while engineered woods such as MDF -- which is a mixture of hard and soft wood bits that have been compressed into board form -- are durable, they're not as strong and sturdy as hardwood. And while MDF, may be stable enough for the short term, hardwood is far more longer lasting. One key fact to keep in mind is that tables with removable legs often tend be made of fiberboards, a material made of pressed wood scraps. It's not a good option for the long-run, but if you'll use the table only occasionally (or if you move frequently) then it can make sense to go with fiberboard. For those of you looking for something beyond traditional hardwood, we like the look of galvanized metal, grainy marble, or molded plastic.
Steer clear of thick veneer. A quick tip for wood table buyers: don't go for thick veneer because it tends to lift away from the piece over time. How do leather recliner you know that the veneer is thick? It'll feel plastic-y to the touch and have obvious "seams" where it connects at corners.
Measure the room. It's important to have the exact measurements of the room for your dining table. This is especially crucial with smaller dining rooms, as many people buy tables that are too big for the space. For example, a rectangular table in a small rectangular room can easily fill up the space and make it look cramped instead of cozy. Remember that you have to be able to walk around the table after chairs have been put into place so it's good to keep about a 50" space between the edges of the table and the walls all around.
Decide on your table's shape. While the style of your dining table -- whether it's farmhouse-style or it has a pedestal base -- is purely your call, there are some general rules when it comes to a dining table's shape and the room it's best suited for. For smaller rooms, go with an oval table to keep the space from looking overly crowded. Square tables work in narrow dining areas but rectangular pieces, which take up the most room, require a long and narrow space. Round tables can accommodate the most people (and tablecloths look best on them) but they're not for small spaces as it limits the way traffic can flow around the room.
Check the table's dimensions. Most dining tables are consistent with the standard height range of 28"-30" tall. The most comfortable dining tables leave enough room above the knee and are at about the same level as your elbows when you're sitting down. As for width, oval, rectangular and square tables are usually a standard 36"-wide with varying lengths depending on the number of people you're looking to accommodate. To give an idea, a 84"-long oval table can accommodate up to 10 people.
Use leaves to maximize space. If you have limited space but need a table that can entertain bigger parties, a good solution is to look for a a table with leaves, which can fold and expand as needed.
Consider outdoor materials. When furnishing an outdoor terrace or patio with a dining table, you'll need to use weather-resistant materials, naturally. The most common are natural teak, which develops a beautiful patina over time from weathering and sun exposure, and powder-coated steel, which is impervious to rain and rust. Also, natural teak and powder-coated steel will be advertised in the product description so make sure to read those -- there are lots of imitators. Added bonus for teak: it doesn't warp or require tons of sealing.

Justin Bieber and Usher were ordered by a U.S. appeals court on Thursday to face a $10 million lawsuit claiming the singers illegally copied parts of a song composed by two Virginia songwriters.
By a 3-0 vote, the 4th U.S. Circuit Court of Appeals in Richmond revived a May 2013 lawsuit by Devin Copeland, an R&B singer known as De Rico, and his songwriting partner Mareio Overton, saying a lower court judge was wrong to dismiss it.
The plaintiffs claimed that three versions of the song "Somebody to Love" recorded by Bieber, Usher or both shared the beat pattern, time signature, and similar chords and lyrics with their song with the same name.
"After listening to the Copeland song and the Bieber and Usher songs as wholes, we conclude that their choruses are similar enough and also significant enough that a reasonable jury could find the songs intrinsically similar," Circuit Judge Pamela Harris wrote for the appeals court.
Among the other defendants were publishers such as Vivendi SA's Universal Music Publishing Group and Sony Corp's Sony/ATV Music Publishing.
Defense lawyers did not immediately respond to requests for comment.
Duncan Byers, a lawyer for the plaintiffs, in an interview said the panel "recognized what my clients have said all along: it's the same melody and the same chorus."
The lawsuit will return to the lower court.
One version of "Somebody to Love," recorded by Bieber and credited to him as a co-writer, peaked at No. 15 on the Billboard Hot 100 in 2010.
The plaintiffs alleged that music scouts had played their song, which was written in 2008, for Usher, who liked what he heard and then brought it to Bieber.
U.S. District Judge Arenda Wright Allen dismissed the lawsuit in March 2014, saying no reasonable jury could find copyright infringement.
Harris, though, said even the lyric "somebody to love" was delivered in an "almost identical rhythm and a strikingly similar melody."
The judge also said it did not matter that the Bieber and Usher versions qualified as "dance pop, perhaps with hints of electronica" while the Copeland version was "squarely" R&B.
She said to rule otherwise could give artists too wide a berth to profit from others' songs, such as through unlicensed reggae or heavy metal versions of the Beatles' "Hey Jude" that had a different "concept and feel."
The case is Copeland et al v. Bieber et al, 4th U.S. Circuit Court of Appeals, No. 14-1427.

None of this is new to you. You've probably already found the best bargain stores in your area to buy all the things you need on a regular basis.
However, there is something that you may not know about: did you know that you actually can buy many products at even lower prices than the best discount store in your area? How is this possible? By buying at wholesale prices. By buying products at the same place that your local store buys. This is what we would like to explain to you now: how to buy almost anything you need at wholesale, so that you can cut your spending by 50%.

Buying Wholesale Versus Buying Discount
How much money can you really save if you buy at wholesale prices? To answer this, let's look at the office furniture sell profit structure of the retail market.
Most retail stores will mark up the price of their products 100%, or double their own cost. In this example, you can obviously save 50% of your money if you make your purchase directly from the wholesaler, instead of buying from the store. Essentially, by buying directly from the wholesaler, you are not paying any service premium to the retail store. The retail store can charge more than the wholesaler because it is more convenient for the buyer to find most products in a retail store than to hunt around for a wholesaler that does not have a prime storefront location in the middle of town.
Also, many wholesalers will not sell items to an individual consumer; they will only do business with an established business that will buy in volume from the wholesaler. Often the wholesaler will have minimum purchase requirements, which can be as low as $500.00 or as high as $20,000.00. Basically, most people accept retail prices as a fact of life because it takes some extra effort and time to figure out how to reach the wholesaler directly, and in many cases, it just is not possible to deal with the wholesaler, unless you are an actual business (which is a good way to get wholesale prices and which will be the topic of a later chapter).
Now let's look at the structure of discount pricing, which is what most people look for in saving their money. When a store offers discount prices, they will not mark up the item 100%; they will offer a discount from the full retail price of 20-40%. They still need to make a profit, so they won't reduce the price 50%, but they are making less of a profit in the hopes of getting people to do business with them. As an example, take an item that normally sells for $100. The store paid $50 for that item. Instead of charging $100, the store may discount that item to $80 or even $60. At the lowest discount you can save $40. However, that doesn't give you as much of a saving as buying the item yourself for $50 directly from the wholesaler. In other words, even the best discount value will not be as good as buying the item at wholesale.
The only exceptions to this rule are liquidation or closeout sales, where the store sells the item at below its own cost, because it must regain some of its original investment in the merchandise. In this case, you may get a better deal from the store than if you went directly to the wholesaler, but these cases are not easy to find and don't occur very often.
Another point about buying from a discount store is that you have to be careful about how many of their products are really being offered at discounts. A common strategy is to lure buyers into the store with large discounts off normal retail prices on a few popular items. Then when you are in the store, many of the other items will be selling at full retail price. In many cases, you just won't be able to tell if an item in that store is full retail or discounted, since it's impossible to do price comparisons on every item when you're in the store itself.
So far, we've been using the example of a typical 100% markup. There are many types of products that are not marked up that much, but the overall principles discussed still apply. For example, products in the electronics business are not marked up as much as gift items. In other words, an answering machine, considered an electronics product, will be marked up only 50% by the retail store. Consequently, the discount offered by a discounter of electronic goods will not be as high as 40%; it will be closer to the range of 15-30%.
Let's take a specific product, a Panasonic answering machine. Currently, one model retails at about $50. The major discount stores are offering it for $44 (a discount of 12%). National Wholesale Company (a genuine wholesale company to be discussed in a later chapter) offers it at $30 (a discount of 40%). Even though the wholesale price is not a 50% discount from retail, it still gives a large saving when compared with the discount store.
The only issue we haven't addressed is the importance of volume. We have been slightly simplistic in this discussion, since we haven't considered how volume changes the wholesale price. If you buy 10 of an item from a wholesaler, the price per item will be less than if you buy 1. If you buy 1000, the price will be much less than if you buy 10. What this means is that it is possible to find that a discounter who buys in huge volume may offer a product at the same price at which you could buy it directly from the wholesaler. Since the discounter is buying from the wholesaler at a lower price than you are, he can mark the price up a little bit and still match the price you are paying to the wholesaler. This will only apply to those products where the volume is very large, and again, you must be careful about other products that same discounter is offering--they may be much higher than the wholesale price you can get yourself.
This discussion has just been a brief analysis of the structure of the retail market. It is clear at this point that it is much better to buy your products from the wholesaler than from retail stores or from discount stores. Up to this point, we've discussed how you can save money on all your purchases by buying at wholesale prices. Now we'd like to discuss one more step you can take to insure that you never have to pay retail for any purchase again.
Setting up your own business is a great way to save money. In addition, it's a way you can actually make more money, even if you already have a job. By having your own legitimate business, you come out ahead both in spending and in earning.
First of all, what are the advantages of having your own business? The main advantage in terms of saving money is that you will gain access to suppliers that you could not have access to as an individual. There are many companies that just will not sell to a consumer; it's against their policy. If they did sell to consumers, they would be competing against the stores they are selling to. But once you are set up as a legitimate business, you become automatically qualified to do business with many of these suppliers.
As an example, when you have a business, you can go to trade shows, where suppliers display their products for all the retail stores to do their shopping. At these shows, suppliers will actually write up orders, often ignoring any minimum requirements they normally have for retail stores. They understand that stores must have samples to take back to their colleagues to study and decide if they want to carry the product in their store. This means that you can order samples from these suppliers at true wholesale prices. You could never do this without having a real business.
Another major place that you gain access to is the permanent showroom in your area for all the wholesalers. All major cities have a large merchandise mart, where all the suppliers can display their products on a permanent basis. With a business card or a certificate showing that you own a business, you can gain access to these showrooms. Without a genuine business of your own, you would not be allowed to visit these showrooms.
To find out where these showrooms are, you can either look under "wholesalers" in your yellow pages, or ask one of your local stores where they do their buying.
To find out about the trade shows, you can ask the wholesalers or the stores. In addition you can contact the association related to the area you are interested in, such as house- wares or giftware. These associations know what major trade shows are coming up in their product area. The addresses and telephone numbers of these associations are listed in a huge directory called the Encyclopedia of Associations, which you can find in your local library (the librarian will know about this book). At your library, you can also look for magazines that are specifically geared toward a particular type of business, such as Gift Reporter for the gift industry, where there will be listings of upcoming trade shows.
Another excellent reference source is the Wholesale by Mail Catalog, which lists 1,000's of wholesale sources with discounts of up to 90% off list prices. You can find out more about this valuable reference tool at the back of this book.
To set yourself up as a business is very simple. All you need to do is contact your local county clerk's office for the details. The regulations vary from state to state, but generally you will be required to register your company with the county clerk and pay some small registration fee. In addition, you'll need to apply with your state's taxation department for a sales tax number, which allows you to collect sales tax from your customers and which allows you to buy merchandise that you are reselling, without paying sales tax yourself. These steps are very simple and will be explained fully by your local county clerk's office.
After registering your company, the only other thing you need is professional stationery and business cards. This is vital, especially when you are just starting, because it is the main impression that suppliers will have of you. Sometimes, a business card alone is all that you need to enter a trade show. This should be your first investment in your business. Once you have registered your business and have printed your stationery and business cards, you'll also want to open a separate business bank account, so that all your checks are written on a company account. One of the most important elements of increasing profits for you and your business is reducing your costs. This is as important as increasing your revenue. This area of cost reduction should never be overlooked, because it can yield very large profits to you. For your business to really enjoy the maximum profits, you should know some basics on negotiating prices with suppliers. That is the purpose of this chapter.
Now that you have a list of suppliers for virtually any product you might want to buy or sell, it is time to discuss negotiating prices. All the ideas in this chapter have been gathered from conversations with executives in wholesale firms.
No Price is fixed
No price is fixed when you're dealing with a wholesaler. This is unlike a retail store, where prices are clearly marked and rarely changed by bargaining. The wholesaler is always charging different prices to different customers (based on their volume), so he is much more flexible in his pricing.
Knowing that prices are not fixed is the basis for beginning any bargaining.
Develop A Good Relationship with the Supplier.
This one rule, developing a good relationship with the supplier, is probably the most important one you'll ever need, especially if you plan to do business with a supplier over a long period of time.
The reason for this is simple. If a supplier likes you and sees you as one of its better customers, they will be more likely to let you know about special deals they have in the future, such as company promotions, overstocked items, or new hot products. Any time they have a special deal that is limited, they will offer it automatically to their best customers. If you're on that list, you'll end up saving more money than most other customers. Also, once you've established a relationship with the supplier, they will be very happy to give you the very lowest possible price they can afford, because they value your business.
At times, it may be more important for you to put this relationship ahead of saving a few more dollars on a particular item, because the relationship will save you hundreds, even thousands of dollars over a long period of time.
To develop a good relationship takes common sense. First of all, try not to be unrealistic in your demands. You have to recognize that the supplier needs to cover his expenses, and must make some profit. If you try to squeeze a supplier too much in demanding a better price, you can ruin the relationship. There's nothing more aggravating to a supplier than someone who is completely unrealistic in his demands.
The best way to develop the relationship is to find one sales rep and stick with him or her. Making a personal contact will make everything much smoother for you, and will ensure that you get the best prices. Because the sales rep works on commission, he will do everything he can to help you do more business. He will take a personal interest in your business, because he knows his commission depends on how satisfied you are. If you are always talking to different reps, they will not know you and how much business you are giving them. People by nature are more conservative when dealing with strangers.
Always ask for 5-10% off the First Price
When you first contact a supplier, you can expect him to give you a price, which is about 5-6% more than what their regular customers get. This is because you are new to them and they need to make as much as possible on each sale. You should expect this and never accept the initial price offered. Start by asking for the 5% reduction, and then try for 10%. You need to persuade the supplier that you are very serious about his products, and that you expect to do large volume with him. Just say that now you are testing the waters with a small order, to see how the product works, how efficient the shipping is, and how reliable the company is. If you can convince him that you may give him a lot more business in the future, you can easily get that 5-10% reduction on your first order.

Wind Energy in the Dominican Republic Would Provide New Light for Progress

Energy is the fundamental catalyst for the development of nations. Without energy, societies are bound to stop growing and eventually decay to nothing. Developing nations, like the Dominican Republic, face many socio-economic issues as they push for progress. Energy is one of the crucial inputs for socio-economic development (Mathew 1). According to Volkmar Lauber, professor at the University of Salzburg, Austria, in order for developing nations to achieve sustainable development and alleviate poverty, they must provide access to affordable energy services (83). The proper and sustainable supply of energy is essential to provide a solid foundation for growth for nations like the Dominican Republic. Inadequate energy supply is an invitation for roadblocks and unnecessary struggles that would deter the potential of a nations ability to develop. The Dominican Republic, unfortunately, is a nation that has an inadequate energy supply.
The Dominican Republic suffers from energy problems that thwart development for the Dominican people. One of the energy troubles is the lack of confidence in the energy sector that came from the lack of supply, and as a result of this deficiency, power outages have affected the country dramatically, causing social unrest and private sector claims. During 2008, an average power of 374 Mega Watts was demanded monthly and not met (GTZ 82). Professor Lauber states that a lack of clean and affordable energy has serious consequences for health, quality of life, and the economy (84). The National Energy Commission of the Dominican Republic effectively describes how not only is there a lack of energy, but there is a vicious circle of cycling financial crisis among distribution companies, lack of investment in energy sources, and constant failure in energy bill payments and fraud (60). Also, high dependency on oil, loss of trust from private investors and consumers, and expensive tariffs on energy prices are issues that accumulate onto the list of energy supply problems in the Dominican Republic (NEC 60). In addition, of the 3,191 Mega Watts that fed the electric grid in 2009, 84% came from fossil fuels, mainly from petroleum-based sources that the nation does not produce (GTZ 82). This means the nation relies on an imported, expensive, and pollutant source that will impede any goal to achieve a sustainable method for energy generation. The Dominican Republic faces many more years of vicious circles, serious consequences, and a dark pollutant path if a more sustainable approach is not taken.
In order to adopt a more sustainable, reliable, and cheaper energy supply, the vicious circle must come to an end. In 2000, the nation pumped roughly 39 million[1] pounds of carbon dioxide into the atmosphere due to energy consumption (SEMARENA 98). Among the different options for providing energy, wind could possibly represent a new light and hope. By implementing new technologies, wind is now one of the most cost-effective methods of electricity generation, making the wind energy market one of the fastest growing renewable energies (Boyle 244). Developing countries are increasingly recognizing the various advantages of renewable energy including a clean energy independent from fossil fuel imports capable of providing energy sustainability (Lauber 86). The matter is whether the Dominican Republic could develop wind energy while balancing the existing environmental, economical, and societal concerns that may inhibit tapping into this clean energy source.
Building on its history, wind energy offers great potential for development in the Dominican Republic. Wind has been used for thousands of years for milling grain, pumping water, and propelling sails for boats (Mathew 2). Currently, wind energy is being harnessed for electrical generation through wind turbines. The downside to using wind energy, however, is that it requires windy land that can provide enough wind velocity to maximize power outlet from a wind turbine. The National Renewable Energy Laboratory (NREL), a branch of the US Department of Energy, conducted a study on the potential the Dominican Republic has to generate energy from the wind. According to landscaping ideas for backyard the research, about 1,500 square-km of windy land could support more than 10,000 Mega Watts of installed capacity, which can be fully commercialized (see Figure 1). 10,000 Mega Watts can supply the countrys electric needs three times over. Another matter is whether it is feasible to exploit the wind and provide new light to the development of the Dominican Republic.

The environmental, economical and societal feasibility of such a plan can be determined by a case study on the current development of the nations first wind farm. According to Jos Rodriguez, the Business Development Director at Electric Generator Company Haina, otherwise known as EGE-Haina (Empresa Generadora de Electricidad Haina, S.A in Spanish), the wind farm is divided into two separate projects: Los Cocos and Quilvio Cabrera. Though in the same location, the two projects have different investors. Los Cocos will consist of 14 wind turbines, 25.2 Mega Watt generation, and 100% private investment by EGE-Haina. Quilvio Cabrera will consist of five wind turbines, 8.25 Mega Watt generation, and 100% private investment by Electric Consortium Punta Cana-Macao or CEPM (Rodriguez). The 19 wind turbines are located in the southwest region of the Dominican Republic, specifically in the province of Pedernales, between the towns of Juancho and Los Cocos (see Figures 2, 3, and 4). The wind farm will require an estimated US $100 million investment. The project started in March 2010 and will be completed in the summer of 2011 (Rodriguez). These details describe the wind farm that will be used as a case study to analyze the environmental, economic, and social concerns and possible mitigation responses that exist.
Environmental concerns that revolve around wind farms are just one criticism against wind energy in general, and Los Cocos and Quilvio Cabrera specifically. Concerns include the risk that hurricanes could destroy the physical installations. The wind farm also presents risks for the existing natural habitat, including both flora and fauna. Critiques also highlight the potential hazard of bird fatality from flying into the wind turbines blades. While conceding that these are legitimate concerns regarding the environmental risks involved, there are arguments that mitigate these risks.
Evidence shows that the concerns related to flora, fauna, and hurricanes can be alleviated. Although there are risks regarding birds colliding with turbine blades, on a global level, however, the incidence is relatively low. Bird fatalities resulting from collisions runs at one to two birds per turbine per year at worst, with most sites having much less than this or zero (Boyle 276). This implies a risk of 19 to 38 bird fatalities a year for the Dominican wind farm, however, no risk to migratory routes of birds have been identified. Of the flora and remaining fauna, no threats were presented for any species in the area. Additionally, the wind turbines are prepared to react positively upon the presence of a hurricane (Rodriguez). These are promising responses that ease the environmental concerns. Not only can the concerns be addressed, but also other outcomes exist that create benefits for the environment.
In comparison with fossil fuels, wind also affords other environmental benefits that indirectly affect society in a positive way. For example, Los Cocos and Quilvio Cabrera will reduce approximately 70,000 tons of carbon dioxide per year (Rodriguez). The National Energy Commission claims that energy plants that burn fossil fuels emit contaminants that cause environmental problems related to climate change, acid rain, and deterioration of human health (37). These problems caused by fossil fuel burning can be negated by using wind as a resource. For example, clean wind energy can reduce health impacts which result not only in physical suffering but also in economic damage through increased health-care cots and reduced productive working days (Redlinger, Andersen and Morthorst 151). Similarly, by using wind as an energy source, the contaminants that fossil fuels produce would not be released in the air, thus reducing the risk of affecting climate change and creating acid rain. Wind energy offers promising environmental benefits that fossil fuels simply cannot.
Moreover, evaluating the economic anxieties surrounding wind energy in the Dominican Republic is of substantial interest when considering implementation. From a global perspective, wind energy is capital intensive (Tiwari and Ghosal 391). This certainly holds true in the Dominican Republic, where generation costs are higher than those of coal and natural gas plants (CDM Los Cocos 30). This is of primary concern because wind needs additional incentives to entice investors who may see the expensive capital cost of wind turbines and higher generation costs as a less attractive investment.
Despite the fact that wind energy is one of the fastest growing renewable energy sources worldwide, fossil fuels still have a slight edge because they require less capital investment and less generation costs. Government policy, however, can help by providing more incentive to develop renewable energy sources. Dominican Law No. 57-07, a Law on Incentives for the Development of Renewable Energy Sources and Special Regimes passed in 2007, has provided incentives for companies that develop renewable energy. Examples of incentives provided by the law include 100% exemption over import duties and sales tax for equipment, machinery, and accessories required for renewable energy production (GTZ 88). Another incentive is a 100% 10-year exemption over income tax for companies or individuals benefited by this law, until the year 2020 (GTZ 88). These laws provide firm incentives for wind energy development that helps persuade investors, and support wind to compete with fossil fuels.
The development of Los Cocos and Quilvio Cabrera contains economic benefits that positively affect the nation. According to Csar Santos, Business Development Manager at EGE-Haina, the province of Pedernales is in the poorest region of the country, an important percentage of the homes live in poverty and are unemployed. Since wind farms must be built in windy rural areas, it is hopeful that the wind farm will provide a chance for job creation and economic development in the region. If more wind farms would be built, this could represent the possibility of bringing development to more poverty-stricken areas of the nation. Opportunities for labor, such as technicians to build and maintain the wind turbines, will be created. It is important to note that a fossil fuel energy plant can create jobs, however, wind energy creates jobs that have a positive environmental impact. Another economic benefit is that wind comes free of cost, while fossil fuels do not. This fact relieves the dependency on importing expensive fossil fuels, which will save the government from disbursing subsidies or compensating for the difference when oil prices are frozen. Essentially, despite the qualms related to high capital cost and higher generation cost, wind energy has incentives, and other benefits that fossil fuels cannot offer.
Social concerns are also of great importance due to the direct interaction that wind farms hold with communities. Wind farms generally present issues about noise and visual impact that concern communities (Boyle 270). A wind farm will admittedly change the visual landscape of the physical area in which it is built. Also, the spinning turbines cause increased noise levels. Both impacts can be for good or bad, depending upon the opinions of the communities affected. Some communities might perceive a wind farm in an open field as a detriment to the natural beauty of the landscape. On the other hand, some might view a wind farm as a potential major tourist attraction because of the aesthetic layout of the turbines. For example, the British Wind Energy Association notes that wind farms in the United Kingdom are popular tourist attractions, with thousands of people each year flocking to visit them (North Carolina Wind Energy Group). Overall, the subject of aesthetics is sensitive as the voices of the people can bring down or praise a wind farm.
From a global perspective, however, research shows that social concerns can be addressed to a certain extent. Complaints that are more resistant due to noise levels caused by turbines can be moderated, because as technology progresses, modern wind turbines are generally much quieter than their predecessors and conform to noise emission level requirements (Boyle 270). According to the American Wind Energy Association, a wind farm at a distance of 750 to 1,000 feet is no noisier than a kitchen refrigerator (North Carolina Wind Energy Group). Some wind farms will not encounter opposition due to noise levels, because the distance from a community to the turbines is sufficient to exclude any noise generated. As for the visual impact of wind turbines in open space creating a sensitive arena the beauty or unpleasantness depends on the community members perception of beauty and landscape. For Los Cocos and Quilvio Cabrera, community outreach showed positive results regarding the implementation of a wind farm nearby (Santos). There were no groups or individuals opposed to the wind farm. Moreover, the community viewed the wind farm as necessary to foster development in the province. Though opinions differ among countries, wind turbine technology has evolved to assuage noise problems, and wind farm development could be more accepted and successful in poverty-stricken zones that place greater value on the positive economic impact of a wind farm.
The potential for wind energy development has an advantageous middle ground in the Dominican Republic. Possible environmental, economic, and social concerns about Los Cocos, Quilvio Cabrera, and general global concerns, have alleviation responses of certain extents. Environmentally speaking, developing wind energy means reducing carbon dioxide emissions in the atmosphere, indirectly improving public health, environmental health, and economic development of the Dominican Republic. Wind energy has the potential to compete with fossil fuels and is financially feasible, if paired with the necessary incentives provided by government laws. Also, cultivating wind farms provides a key opportunity to develop rural areas that suffer from high poverty levels, like the province of Pedernales. Lastly, from a societal view, despite the highly subjective opinions regarding noise levels and visual impacts, technology improvements can eliminate the noise level problems. Additionally, communities in third world countries such as the Dominican Republic might value the economic impact over the aesthetic impact of a wind farm. Conceding that the case study of Los Cocos and Quilvio Cabrera is not sufficient to generalize that the entire nation will accept wind energy implementation. The province of Pedernales holds the highest potential to generate electrical power from the wind, and Los Cocos and Quilvio Cabrera represent the first step for more wind solutions and collaboration to develop the renewable source. Ultimately, the Dominican Republic has an adequately equipped platform economical, environmental, and social to foster wind energy, however, the nation also needs another type of platform.
The other platform is not a matter of proving feasibility, but instead pertains to principles of the people. A renowned American environmentalist, Aldo Leopold, wrote extensively on environmental ethics and provides significant insight to the subject of ethical land use. For Leopold, environmental problems raise issues to fundamental moral questions about the quality of human society and its direction (Elliot and Opie). Leopold believed there is a connection between humans and land thus it is a moral responsibility of humans to maintain the integrity of their land. This is not referring to implementing severe restrictions to land use, but rather to use land for the benefit of the land and the people. How [people] behave toward their environment reveals their culture (Elliot and Opie). Nations act responsibly when they take care of their land and use it wisely to improve the quality of life of its people and environment. This is the platform of principle that people must value in order to make better use of land for a better life and environment. The Dominican Republic can be pragmatic about ethical land use by developing wind energy that would improve quality of life, the environment, and foster the nations growth.
The Dominican Republics development is a reflection of the way the nation uses its resources and land to achieve progress. The nation suffers from a lack of electrical power, dependency on fossil fuel imports, and high-energy prices that hinder Dominican development, personified in the vicious circle. The consequences caused by unsustainable energy generation also affect quality of life and the environment. It is in the interest of the nation and the people to improve their quality of life and care for the environment, as this will provide long lasting results that aid development. The Dominican Republics reflection must change in order to achieve more development and progress.
The face of change lies in varying the use of land and resources. It would largely benefit the country, as well as the environment, to make wind a primary source of energy. The development of wind energy means to use land to provide solutions for better quality of life, and environment. Also, wind energy provides a clean and substantial solution to the energy problem, and can help promote development in the Dominican Republic. The National Energy Commission highlights the importance of diversification of energy sources (9), and also claims that 100% of electrical demand will be met by 2011 (44). Accomplishing this will aid the development and energy security of the nation. However, diversifying energy is necessary. A larger push towards wind energy should be emphasized because of its abundance and ability to achieve greater self-sustained energy generation. Regardless of whether the nations energy needs are met, this does not expel the ill dependency on imported fossil fuels. Fossil fuel dependency for energy generation will only uphold the vicious circle affecting the nation and deterring its possible growth. Developing wind energy in the Dominican Republic would induce environmental, economic, and social benefits bringing new light to the nations progress.

We've heard about criminal defense lawyers, we've watched them on television in the multitude of cops and lawyers kind of shows, some may have even been for a real life court proceeding, and are aware of how they function for real. Criminal defense lawyers can never have a dull moment, because there is always someone in need of their services. But who is a criminal defense lawyer? What is the job about? What is the salary like? There surely must be umpteen questions that you may want answered, so right from requirements to become a lawyer, to criminal defense lawyer salary, we'll take a look at everything.
Criminal Defense Lawyer: Job Description
To begin with, as in the case of any lawyer, a criminal defense lawyer acts as a representative for his client. When a person has either committed a crime, or has even been impeached for one, it is the criminal defense lawyer who acts on his client's behalf. When employed by the government, they are also known as public defenders. In terms of education, the rules do not change. Four years of school to obtain a bachelor's degree, followed by taking the Law School Admission Test, then moving on to three years in law school, and finally receiving the Juris Doctor degree. For a more detailed look on how to become a criminal defense attorney, you could take a look at career as a lawyer, as it will cover the basics. Moving back to job description, a lawyer of this kind would spend roughly 40 hours a week, working. The hours spent working are normally consumed by meeting with clients to discuss their case, doing extensive research regarding the same, and in case of trials, working on matters where witnesses may be cross examined. It is essential to bear in mind that a job like this generally demands for a lot of time to be spent in research, so as to build up a strong case in favor of the client.
Criminal Defense Lawyer: Salary
The interesting part about the salary of a criminal defense lawyer is the fact that salaries are charged on the basis of the crime that is being defended. While the basic average salary could range from $45,000 to $150,000 annually, with the addition of certain other perks it could go all the way up to $175,000 too. Most lawyers of this nature charge a flat fee depending on the crime in question. The range of these crimes could be right from a white-collar conspiracy, to possession of narcotics, or even DUI (Driving Under the Influence). It goes without saying that a white-collar crime means big bucks, as against something like a lesser offense like DUI. In a whole lot of cases salaries also depend on where they are employed. This could refer to both, state or city of employment, as well dui lawyer reviews as place of employment, in terms of the firm that they work at. Very evidently a criminal defense attorney working at a private firm is likely to earn more than a public defender, but either way, the annual salary and earnings of a criminal defense lawyer are good. Added years of experience and becoming a partner in a firm increases the chances of a higher salary even further. It is therefore advantageous in cases like these to work at a private firm or as a private attorney.
Apart from the above mentioned, the usual factors such as education, experience, etc., always play a key role too. Once you have that part of it figured out, there's absolutely nothing that can stop you from establishing yourself in this line, and from drawing a fabulous salary.

Federal Judge orders cancellation of Washington Redskins' trademark registration
ALEXANDRIA, Va. - A federal judge on Wednesday ordered the cancellation of the Washington Redskins' trademark registration, ruling that the team name may be disparaging to Native Americans.
The ruling by Judge Gerald Bruce Lee affirms an earlier finding by an administrative appeal board. Bruce ordered the federal Patent and Trademark Office to cancel the registration.
Lee emphasized in his 70-page ruling that the organization is still free to use the name if it wishes - the team would just lose some legal protections that go along with federal registration of a trademark.
The team had sued to overturn a ruling against it by the Trademark Trial and Appeal Board. The team argued that cancellation of its trademark infringed on its free-speech rights because it required the government to judge whether the name is offensive.
The organization can appeal.
"I am surprised by the judge's decision to prevent us from presenting our evidence in an open trial. We look forward to winning on appeal after a fair intellectual property rights in india and impartial review of the case," said Washington Redskins president Bruce Allen. "We are convinced that we will win because the facts and the law are on the side of our franchise that has proudly used the name Redskins for more than 80 years."
Jeff Lopez, lawyer for the Native Americans who challenged the team's name, said he expects the Redskins to appeal the ruling to the 4th U.S. Circuit Court of Appeals in Richmond. But he said that Lee's ruling was an property lawyers across-the-board victory for his clients and that he is confident it will be upheld.
Lopez said his clients are hopeful that the team will take heed patent and trademark office of the decision and change its name.
In rejecting the team's free-speech argument, Lee cited a U.S. Supreme Court ruling last month allowing the state of Texas to bar depiction of the Confederate battle flag on specialty license plates sought by the Sons of Confederate Veterans.

Specifically, Lee said federal law allows the government to exercise editorial control over the content of the trademark registration program, and he equated trademark registration to government speech as opposed to private speech.
Lee said the legal standard for canceling the registration is whether the name "may disparage" a substantial composite of the Native American community. Though the team has maintained that the name honors Native Americans, Lee said there is ample evidence that the name may be perceived as disparaging. He cited the fact that Native American leaders have been objecting to the name for decades, along with dictionary citations that the word is typically considered offensive.
Google Testing Teal Colored Stars in AdWords, Local & Reviews
Google is testing a brand new color of stars in their search results this time teal. They are using this color to replace the usual orange colored stars on the entire page, including for AdWords, local knowledge panels, local 3-packs and all reviews and ratings.These are a true teal / turquoise color. We have seen green ones previously that matched the URL green color, but these are definitely more blue than the usual Google URL green. And it is a different shade than the green stars Google was testing last year, for those of you that watch that closely. It also marks a departure from the star colors they normally test that match the Google logo.

This is a limited test, as I wasnt able to see them how to promote my business locally in all browser sessions. But you may see Google testing a variety of colors if you do some searches with stars in them.
